A Tweedmouth man has admitted a charge of racially aggravated behaviour towards Kashmir and Sharan Nijar at the Foulis takeaway. Lee Machin, 42, of Main Street, pleaded guilty to the offence when he appeared at Berwick Magistrates’ Court on Thursday. Magistrates heard that the incident happened around 8pm on December 8 after the defendant had taken delivery of an order made with the Just Eat app. James Long, prosecuting, said: “The defendant went back to the shop to complain about the order. The owner thought there was nothing wrong and that the defendant’s complaint was groundless.” The court heard that the defendant asked for a refund but was told it would have to be sorted out by Just Eat. He became abusive and started shouting, magistrates were told. He was warned that there was CCTV but he continued to shout racial obscenities. He left the takeaway banging on the windows and continuing to shout racially aggravated obscenities. Mr Long said: “Very unpleasant, abusive and racist language was used towards the couple.” Ian O’Rourke, in defence, said the defendant felt a pizza box had been turned upside down during delivery. “He just snapped,” said Mr O’Rourke. “He apologises to the court and the complainants.” He was told to pay a fine and costs of £235 and £100 compensation.
